This channel is a communication pathway where we have set up the Complaint Channel, to report actionable irregularities that may occur within the scope of Law 2/2023 of 20 February.

And the Sexual Harassment and Gender-Based Harassment Prevention Channel, where the utmost priority across our organization is based on commitment and zero tolerance towards any behavior in cases of sexual harassment and gender discrimination.

Whistleblowing Channel at Guitart Hotels

This whistleblowing channel serves as a means of communication through which anyone, whether part of the company or not, can report any alleged irregularities that might occur within the scope of the Law 2/2023, dated 20th February.

WHAT ISSUES CAN BE REPORTED?

You can report through the ethical channel any matters you believe may constitute a breach of legal regulations, the ethical code, or any current internal regulations, such as:

Financial crimes or crimes against property, competition offences due to non-compliance with data protection regulations, and other serious infringements. Matters related to advertising, complaints, etc., should be addressed through customer service. This channel is exclusively for reporting breaches of internal and external legal regulations.

Guitart Hotels makes available its Whistleblower Channel through:

- The option to provide information directly to the Information System Manager represented by the designated person.
- By telephone call.
- By postal mail to: Guitart Hotels, S.L., C/ Constantí Ribadelaigua, 7, Postal Code 17310 Lloret de Mar (Girona).

In addition, external information channels are also available with the competent authorities (Independent Whistleblower Protection Authority or the Catalan Anti-Fraud Office), and if necessary, with the Institutions, bodies or agencies of the European Union.

Upon submitting a complaint to our Complaints Channel, the procedure will commence in accordance with the provisions of Law 2/2023, aiming to notify Guitart Hotels, S.L. of any irregularity related to our staff, products, facilities, the group's image, or any other matter the complainant deems worthy of investigation.

Exclusive access to this content will be granted to the individual appointed by the Ethics Committee. This individual will be responsible for the routine management of the Channel, its internal control, and compliance.

The Ethics Committee will act at all times independently and autonomously, maintaining the confidentiality of the complaints received, the documentation provided, the third parties involved, and all generated information. It will ensure at all times that no form of retaliation or sanction is taken against those who have lodged a complaint, as set forth in Article 36, as well as the support and protection established in Articles 37 and 38 of Law 2/2023.

HOW TO SUBMIT A COMMUNICATION? 

Through the website

Access it through the following link:
1. Click the “Make a click” button and then enter the GUITART code.
2. Select the channel button.
3. Write your message being as specific as possible. You can attach both images and documentation.
4. Identify yourself or select the anonymity option. In either case, you must accept the Privacy Policy.
5. In this case, you will receive a unique identifier code and password that you must keep to maintain communication through a secure chat about the status of your click.
6. Whenever you want to know if you have a new message in the chat or want to provide more information, to ensure confidentiality, you must enter this code and password on the home page, under the “Access a previous click” button.

Using the co-resol app
  1. Download the co-resol app, accepting notifications. It is free and available on the App Store and Google Play.
  2. Click the “Make a click” button and then enter the Guitart code.
  3. Select the channel button.
  4. Write your message being as specific as possible. You can attach both images and documentation.
  5. Identify yourself or select the anonymity option. In either case, you must accept the Privacy Policy.
  6. Once you have completed these steps, you will receive a message acknowledging receipt of your click.
  7. Communication for tracking the click will be conducted through a secure chat (you can access it from the chat button on the home screen) until it is closed.

We have created a protocol by which GUITART HOTELS, S.L. wishes to underscore its commitment to the measures that make up this protocol, and expressly declares and advertises its willingness to adopt a proactive attitude both in preventing the referred conduct of sensitization and information of behaviors not tolerated by the company, as well as in the dissemination of good practices and the implementation of as many measures as necessary to manage complaints or claims that may be raised in this regard, as well as to resolve as appropriate in each case. Informing its application to all personnel providing services in its organization, including individuals from other companies.

This protocol will apply to situations of sexual harassment, harassment based on sex, and other conduct against sexual freedom that occur during work, in connection with work, or as a result of the same. It is implemented in coherence with the European Framework Agreement on harassment and violence in the workplace and complies with the requirements of ILO Convention No. 190 on the elimination of violence and harassment in the world of work; Articles 46.2 and 48 of Organic Law 3/2007 of March 22, for the effective equality of women and men; Article 12 of Organic Law 10/2022 of September 6, on the comprehensive guarantee of sexual freedom; Royal Decree 901/2020 of October 13, which regulates equality plans and their registration and amends Royal Decree 713/2010 of May 28, on the registration and deposit of collective agreements and work agreements; and Article 14 of Law 31/1995 of November 8, on the Prevention of Occupational Risks.
